Uninsured drivers and accidents

On average, 14,000 South Africans die from severe road accidents every year. Unfortunately, this statistic is among the highest in the world, according to Discovery Insurance.

They further confirm that around 83% of road accident injuries and fatalities are in economically productive age groups – that is, people aged between 15 and 64 years. It is also estimated that as many as 70% of the more than 11 million registered vehicles in the country are not insured for accidental damage.

So what then to do when you are involved in an accident with someone who is not insured for such an incident?

Follow all the normal procedures and report the accident within 24 hours at your nearest SAPS.  Get as much information from the driver as possible and take photos of the accident and drivers licences.

The person who causes the accident will be liable for the cost thereof.  This will include the damage to your own vehicle, and the damage and injuries you caused other persons with the accident.

If the damages is below R 20 000 then you will be able to use the small claims court and recoup the costs through than institution at a relative cheap expense rate.  However, if it is more you will have to institute legal action through a lawyer to get your damages covered. 

It is important to not wait to long to institute the action as these claims can prescribe after 3 years of the accident.  Be diligent and contact your lawyer as soon as possible after the accident
