The repercussions of providing incorrect information to the police after a motor vehicle accident.

A lot of people are under the impression that should you be involved in a motor vehicle collision, especially if you are the party in the wrong, it is wise to provide incorrect information to the police in order to cover your own tracks. However, the latter mentioned conduct may be very prejudicial to you as you might even end up in prison as a result of such.

Procedurally, when involved in a motor vehicle collision, you should report same at your nearest police station in order for an accident report to be compiled by the police. Should there be any injuries and/or fatalities, the police shall proceed to take ‘statements’ from all those involved and/or witnesses to the collision. The latter mentioned statement shall be taken in the form of an affidavit which is done in terms of the Regulations Governing the Administering of an Oath or Affirmation. The said affidavit shall contain nothing but the truth from the deponent as same is under oath.

The matter shall be sent to court for adjudication thereof and should it at any given time be ascertained that you deliberately misled the police in your affidavit, criminal charges may be laid against yourself for perjury. Should it be the case that you are the person in the wrong during a motor vehicle collision, you should at all times remain truthful as your deceitful conduct might put you in a lot of trouble at a later stage.

Should you be found guilty of the abovementioned charge, it may lead to lead to a fine and/or imprisonment.
