“I have been involved in a motor vehicle accident, in which I was seriously injured during May 2015. In October ... 2015, I consulted an attorney, Mr X, who I properly mandated to institute legal action against the Road Accident Fund for damages suffered by me during the accident in May 2015. I have signed all the necessary documents to lodge a claim with the Road Accident Fund already in September 2016, but have received no confirmation from Mr X, if my claim was submitted. I have now in April 2019 contacted the Road Accident Fund itself and have learned that my claim was never submitted by Mr X. I have established that my claim for damages from the Road Accident Fund has no prescribed. What should I do?”

Does the Section provide sufficient cover for victims of a road vehicle collision? “I was in a motor vehicle collision... in terms of which I was successful in claiming from the Road Accident Fund. The claim succeeded and I received an amount towards my past medical costs, future loss of income and general damages. The Fund further issued me with an undertaking in terms of which the Fund undertook to settle all my future medical costs relating to the accident and the injuries sustained by me. However due to the nature of the injuries I sustained I require frequent wound dressings and medication for the pain. The doctors and pharmacies refuse to accept the said undertaking and inform me that I should pay for the medical expenses and claim same back from the fund. What should I do and how should I go about claiming?”

How to lodge a claim with the Road Accident Fund for Patrimonial and Non-Patrimonial damages?

Section 24 of the Road Accident Fund Amendment Act 19 of 2005, makes provision for a third party seeking compensation... for patrimonial and/or non-patrimonial damages, in respect of any loss or damage suffered, as a result of the bodily injuries or death of another, caused by or arising, out of the driving of a motor vehicle. The prescribed claim form 1 must contain sufficient information together with the necessary documentation to enable the Road Accident Fund, to realise that the claimant is seeking compensation. Whereas a claim is for general damages the RAF form 4 must be accompanied by the medical reports and opinions. The claim must be lodged timeously and in accordance to the prescribed rules of Road Accident Fund Amendment Act.
