Divorce and Spousal Maintenance – When are you entitled to it?

Divorce is never easy — emotionally and financially. One of the most common questions we receive from clients is: “Am I entitled to spousal maintenance after divorce?” The answer depends on your individual circumstances, the type of marriage, and your financial situation at the time of divorce.

What Is Spousal Maintenance?

Spousal maintenance is financial support paid by one spouse to the other after separation or divorce. Its purpose is to ensure that a spouse who cannot support themselves immediately after the marriage ends, receives financial assistance for a period of time.There is no automatic right to maintenance after divorce, it must be justified and awarded by the Court based on specific factors. You may qualify for spousal maintenance if you can show that you cannot reasonably support yourself after the marriage ends. The court will consider:

  1. Your financial needs and earning capacity
    If you were financially dependent on your spouse during the marriage, or if your earning potential is limited (for example, because you were a homemaker or cared for the children), the court may order maintenance.
  2. The standard of living during the marriage
    Courts try to ensure that neither spouse experiences an unfair drop in living standards, although both will likely need to adjust financially.
  3. The duration of the marriage
    Longer marriages generally create stronger grounds for maintenance, especially if one spouse sacrificed career opportunities for the family.
  4. Your age and health
    Older spouses or those with health issues that make employment difficult are more likely to qualify for maintenance.
  5. The conduct of the parties (in limited cases)
    Misconduct such as abuse or financial neglect may be considered, but the courts generally avoid moral judgments when determining maintenance.

Spousal maintenance is not meant to be punitive but it’s a way to ensure fairness when one spouse is left financially vulnerable after divorce. Each case is unique, and the outcome depends on the facts presented to the court.
